Terms of Service
These terms govern your use of the SIDExSIDE Social Media Planner.

1. What this is, and who you are agreeing with
The SIDExSIDE Social Media Planner (the "Planner") is a web application for scheduling and publishing social media content, available at https://smp.sxsmedia.dev. It is a self-hosted instance of the open-source project Postiz.
The Planner is operated by SIDExSIDE Media Development, a division of Dub Works LLC ("we", "us"). Dub Works LLC is the contracting party under these terms. By creating an account or using the Planner, you agree to these terms. If you do not agree, do not use it.
The Planner is offered to the public, free of charge. Registration is open. There is no fee and no paid tier. Using the Planner does not make you a client of SIDExSIDE Media Development, and does not create a management or representation relationship.
2. Who may use it
You must be at least 18 years old, and old enough to hold an account on each platform you connect. You are responsible for what happens under your account, for keeping your credentials secure, and for the accuracy of the information you give us.
You may only connect social media accounts that you own, or that you are authorized to manage on behalf of their owner. If you connect an account on someone else's behalf, you confirm you have their permission to publish to it.
3. Your content stays yours
You keep all rights to everything you upload and publish through the Planner. We claim no ownership of it. You grant us only the permission we need to operate the service for you: to store your content, and to transmit and publish it to the accounts you connected, at the times you scheduled.
Media is not stored indefinitely. Files you upload are deleted automatically on a rolling schedule after publication. The Planner is not a backup service or an archive, so keep your own copies of anything you care about.
4. Acceptable use
You agree not to use the Planner to:
- publish content that is unlawful, infringing, harassing, hateful, or sexually exploitative;
- publish content you do not hold the rights to;
- violate the rules or terms of any platform you publish to;
- send spam, run automated bulk engagement, or operate coordinated inauthentic behaviour;
- publish to accounts you neither own nor are authorized to manage;
- attempt to access another user's workspace, content, or connected accounts;
- attempt to gain unauthorized access to the Planner, or to the systems it runs on, or to disrupt them for others.
We may suspend or remove an account that breaks these rules, or where required to protect the service, other users, or our standing with the platforms we integrate with. Where it is reasonable to do so, we will tell you why.
5. Third-party platforms
The Planner publishes to third-party platforms including YouTube, TikTok, Instagram, Facebook, and Discord. Your use of those platforms is governed by their own terms and policies, and you remain responsible for complying with them. Specifically, your use of the Planner's YouTube features is also subject to the YouTube Terms of Service, and its use of Google data is subject to the Google Privacy Policy.
Those platforms may change, restrict, or revoke API access at any time, which may interrupt or permanently disable parts of the Planner. We do not control them and we are not responsible for their decisions or their availability.
6. Availability, and the honest disclaimer
The Planner is provided "as is" and "as available", with no warranty of any kind. It is a free service running on our own infrastructure. We do not guarantee uptime, and we do not guarantee that a scheduled post will publish. Posts can and do fail, because of a server problem, a network outage, an expired authorization, or a change made by a destination platform.
Verify that anything important actually published. Do not rely on the Planner as the only safeguard for a post that matters. This is a real failure mode, not boilerplate.
We may change, suspend, or discontinue the Planner, in whole or in part, at any time. If we discontinue it entirely, we will make a reasonable effort to give notice so that you can disconnect your accounts and retrieve anything you still need.
7. Limitation of liability
To the fullest extent permitted by law, Dub Works LLC and SIDExSIDE Media Development shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, content, revenue, reach, followers, or profits, arising out of or relating to your use of the Planner, whether or not we were advised such damage was possible.
Nothing in these terms limits liability that cannot be limited under applicable law.
8. Ending it
You may stop using the Planner at any time. You can disconnect any channel from within it, and you can ask us to delete your account and its data by writing to info@sxsmedia.dev. Revoking our access from the platform's own settings works too, and does not require us.
We may terminate or suspend an account for a breach of these terms, or if we stop operating the service.
9. Changes to these terms
These terms may be updated or amended at any time, without prior notice. Any revised version will always be made publicly available at this address, with the "last updated" date above reflecting the most recent revision. Continuing to use the Planner after a change means you accept the revised terms. If you do not accept them, stop using the Planner and delete your account.
10. Governing law
These terms are governed by the laws of the United States and the state in which Dub Works LLC is registered, without regard to conflict-of-law rules.
